1. Acceptance of Terms
By accessing or using brikoapp.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.
2. Description of Service
BRICKO provides an AI-powered real estate investment analysis platform, including deal analysis, construction budgeting, MEP generation, market trend tools, and related features (the "Service"). The Service is provided for informational and analytical purposes only. Nothing on the Platform constitutes financial, legal, or investment advice.
3. Accounts
You must create an account to access most features of the Platform. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.
4. Subscriptions and Billing
4.1 Plans
The Platform offers a Free plan and paid subscription plans (Premium and Pro). Paid plans are billed on a monthly or annual basis as selected at checkout.
4.2 Billing
By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. All fees are in USD and are non-refundable except as described in Section 4.4. Payments are processed by Stripe.
4.3 Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period; you will retain access until then and will not be charged again.
4.4 Refund Policy
All paid plans include a 5-day refund window. If you are unsatisfied for any reason, contact us within 5 days of your initial purchase for a full refund. This applies only to your first purchase and does not apply to renewals. Refund requests must be submitted by contacting our support team directly; chargebacks filed without prior contact may be contested.
4.5 Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase, and you may cancel before the new price takes effect.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Upload content that is fraudulent, misleading, defamatory, or infringes third-party rights
- Attempt to gain unauthorized access to the Platform or its systems
- Reverse engineer, decompile, or disassemble any part of the Platform
- Use automated tools to scrape, crawl, or extract data without our written permission
- Resell, sublicense, or otherwise commercialize access to the Platform without authorization
- Interfere with the Platform's operation or other users' enjoyment
6. Intellectual Property
The Platform and its original content, features, and functionality are owned by BRICKO and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for your personal or internal business purposes in accordance with these Terms.
You retain ownership of any data or content you input into the Platform. By submitting content, you grant BRICKO a limited license to process and use that content solely for the purpose of providing the Service to you.
7. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED ANALYSES WILL BE ACCURATE OR COMPLETE.
All analyses, estimates, and projections generated by the Platform are for informational purposes only. You should consult qualified professionals (financial advisors, attorneys, contractors) before making any investment decisions.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRICKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
9. Indemnification
You agree to indemnify, defend, and hold harmless BRICKO and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Platform or violation of these Terms.
10. Termination
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease. Sections 6–11 of these Terms will survive termination.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising out of these Terms or the Platform shall be resolved through binding arbitration in Florida, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and, where appropriate, notifying you by email. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
